Acceptable Use Policy
The following are violations of WaveOne policies:
- Reselling or redistibuting Internet access in any form not expressly agreed to by WaveOne.
- Use of any servers including but not limited to, E-mail, NAT, DHCP, DNS and WEB servers not expressly agreed to by WaveOne. In the event of any attempts to utilize a server on the network, WaveOne Enterprises, Inc. may, at its discretion, increase the fees associated with the Service or terminate the Service.
- Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming"). It is not only harmful because of it negative impact on consumer attitudes toward WaveOne, but also because it can overload WaveOne's network and disrupt service to WaveOne customers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, WaveOne has the discretion to determine from all of the evidence whether the email recipients were from an "opt-in" email list.
- Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy, and patents held by individuals, corporations, or other entities. Also, engaging in activity that violates privacy, publicity, or other personal rights of others. WaveOne is required by law to remove or block access to customer content upon receipt of a proper notice of copyright infringment. It is also WaveOne's policy to terminate the privilages of customers who commit repeat violations of copyright laws.
- Using WaveOne's network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material. WaveOne is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through WaveOne's network.
- Using WaveOne's network as a means to transmit or post defamatory, harassing, abusive, or threatening language. Threatening bodily harm or property damage to individuals or groups.
- Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.
- Accessing illegally or without authorization computers, accounts, or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that might be used as a precursor to an attempted system penetration (i.e. port scan, stealth scan, or other information gathering activity).
- Distributing information reguarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mailbombing, or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service, or equipment.
- Engaging in activities that are determied to be illegal, includig advertising, transmitting, or otherwise makeing available ponzi schemes, pyramid schemes, fraudulenty charging credit cards, and pirating software.
- The Services of WaveOne Enterprises, Inc. are provided "AS IS." WaveOne Enterprises, Inc. makes no warranty of any kind, expressed or implied, including but not limited to any warranty of merchantability, fitness for a particular purpose or non-infringement, or any warranty regarding the reliability or suitability for a particular purpose of it services. Customer acknowledges that WaveOne Enterprises, Inc. exercises no control over the quality, validity, nature, content or reliability of the information passing through the network. No oral or written information or advice given by WaveOne Enterprises, Inc., its dealers, agents or employees shall create a warranty. Use of any information obtained from or through Services provided by WaveOne Enterprises, Inc. will be at Customers own risk. Customer acknowledges that WaveOne Enterprises, Inc. is not liable for any errors or interruption in the services, whether within or outside the control of WaveOne Enterprises, Inc. Under no circumstances shall the customer hold WaveOne Enterprises, Inc. responsible for any form of damages or losses including direct, indirect, consequential or incidental damages or losses suffered from, but not limited to errors, delays, loss of information or interruptions in services caused by the customer, WaveOne Enterprises, Inc. or third party's negligence, fault, misconduct or failure to perform. Customer understands that telecommunication and/or network access services may be temporarily unavailable for scheduled or unscheduled maintenance and for other reasons within or outside the direct control of WaveOne Enterprises, Inc. WaveOne Enterprises, Inc. reserves the right to refuse or terminate services to a customer at any time without cause.
